Member Agreement & Terms of Use

1. Introduction

Earthly Alchemy © is a project of Flourish Within, a private members association benefiting its private members, providing education, resources and tools to its members.

Earthly Alchemy provides educational resources, neuroacoustic audio programs, digital content, consultations, workshops, and related materials created to support members on their individual journeys.

By accessing Earthly Alchemy resources, becoming a member, singing up for samples, purchasing products, booking consultations, or using this website, you agree to be bound by the terms contained within this Member Agreement and Terms of Use.

These terms are designed to create clarity, protect the integrity of the community, and establish a respectful relationship between Earthly Alchemy and its members.

2. Membership

Membership Pathway

Membership begins when you sign up for our free samples and guides, complete an online registration process, or purchase resources.

Earthly Alchemy currently offers one membership level:

General Membership – Free Lifetime Membership.

General Membership provides access to:

• Access to complimentary educational resources
• Schedule paid consultations at member rates
• Access the member resources
• Receive member emails and updates
• Invitations to member events

Membership provides access to resources and community participation.

3. Privacy Assurance

Your privacy is a priority for Earthly Alchemy ©.

Personal information collected through membership registration, purchases, consultations, or website interactions is used only for purposes connected with providing resources, maintaining membership records, processing payments, communicating with members, and improving the member experience.

We do not sell personal information.

Information may be shared only with trusted service providers where necessary to operate our platforms, process payments, host digital content, or deliver requested services.

Reasonable steps are taken to protect member information from misuse, loss, unauthorised access, modification, or disclosure.

4. Educational Purpose & Medical Disclaimer

Earthly Alchemy provides neuroacoustic audio programs and related educational resources developed in collaboration with Flourish Within.

All information, consultations, resources, digital downloads and audio programs are provided solely for educational, wellness, relaxation and personal development purposes.

Earthly Alchemy does not provide medical advice, medical diagnosis or medical treatment.

Nothing provided by Earthly Alchemy should be interpreted as medical advice or as a substitute for professional medical care.

Our audio programs, custom tracks and digital resources are not medical devices and are not intended to diagnose, treat, cure or prevent any disease.

Members with existing medical conditions or health concerns should consult their healthcare practitioner before using any neuroacoustic resources

5. Audio Safety

Earthly Alchemy neuroacoustic audio programs are designed to promote deep relaxation and may cause drowsiness or reduced alertness. For your safety, you must not listen to these audio programs:

• While driving or operating any motor vehicle.
• While operating machinery or equipment requiring your full attention.
• While undertaking any activity where reduced alertness could pose a risk to yourself or others.
• In any situation where you are responsible for the safety of others.

Always use the audio programs in a safe, comfortable environment where you can relax without interruption.

By using Earthly Alchemy audio programs, you acknowledge that you are responsible for ensuring they are used safely and appropriately. Earthly Alchemy accepts no responsibility for any injury, loss, damage or accident resulting from the improper or unsafe use of its audio resources.

6. Use of Audio

All audio resources are used entirely at your own risk. Earthly Alchemy accepts no responsibility for injury, discomfort or adverse outcomes arising from:

• Use of audio while driving, operating machinery, or performing activities requiring full attention
• Improper use
• Excessive listening
• Use while impaired, intoxicated, or fatigued
• Use without appropriate medical approval where required

Individuals with epilepsy, a history of seizures, or medical conditions that may be affected by rhythmic sound stimulation should seek advice from a qualified healthcare professional before using neuroacoustic resources. If discomfort, dizziness, anxiety, or any adverse reaction occurs, discontinue use immediately.

For the intended binaural beat effect, stereo headphones are recommended.

7. Intellectual Property & Licence to Use

Ownership

All audio recordings, neuroacoustic programs, music tracks, written materials, digital downloads, graphics, website content, branding, and other resources provided by Earthly Alchemy remain the intellectual property of Earthly Alchemy or its licensors.

Personal Use Licence

When you purchase, sign up for a sample or receive access to an Earthly Alchemy digital product, audio program, or resource, you are granted a personal, non-exclusive, non-transferable licence to use the content for your own private, non-commercial use.

You do not acquire ownership.

Prohibited Uses

You may not:

• Resell any content
• Share or distribute content
• Upload content to streaming services
• Copy, reproduce or publish content
• Modify, reverse engineer or remix content
• Use content for commercial purposes
• Create derivative works

Nothing in this Agreement limits any rights provided under the Copyright Act 1968 (Cth).

8. Website Use & Digital Resources

All content contained on the Earthly Alchemy website, including text, audio, images, designs, graphics, digital materials, software, and other resources, remains the property of Earthly Alchemy or its licensors.

Members and visitors may access resources for their intended personal use only.

You agree not to:

• Copy, reproduce, publish, or distribute website content
• Create derivative works from Earthly Alchemy materials
• Attempt to interfere with website functionality or security
• Use website content in a manner inconsistent with these Terms of Use

9. Waiver of Responsibility

Earthly Alchemy is an educational and wellness resource only. Information shared through consultations, educational resources and audio programs are based upon knowledge, research and personal experience accumulated over many years. Members acknowledge that:

• They remain solely responsible for any decisions and actions they choose to take
• Information provided by Earthly Alchemy is educational and not professional medical advice
• They seek independent professional advice appropriate to your own circumstances

Earthly Alchemy, its team members, consultants, facilitators and volunteers accept no liability for any decisions, actions or outcomes arising from the use of its services or resources. Nothing in this Agreement excludes, restricts or modifies any consumer guarantees or rights that cannot lawfully be excluded under the Australian Consumer Law.

10. Mutual Commitment & Member Conduct

Earthly Alchemy is founded on principles of honour, integrity, respect, and acting with consideration towards others. Members agree to participate in the community in a manner that supports a respectful, ethical, and constructive environment. Members agree:

• Not to engage in conduct intended to cause harm, loss, damage, or injury to others or property
• To communicate respectfully with other members, facilitators, and contributors
• To act with honesty and integrity in all interactions
• To respect the privacy, confidentiality, and individual choices of others

Earthly Alchemy encourages members to embrace the principle:

Do No Harm. Cause No Loss. Act with Honour and Integrity.

11. Payments, Refunds & Cancellations

Workshops and Custom Audio Products

All workshop bookings, custom audio creation services and digital products are non-refundable. This policy exists due to limited availability and production commitments.

Downloaded Content (non-refundable):

Due to the digital nature of audio program, downloads and intellectual property protection, if our records show you have attempted even a single download, no refund is possible.

Once digital content has been accessed or downloaded, the sale is final.

Consultations

• Cancellation more than 48 hours before appointment: refund available.
• Cancellation within 24 hours: 50% cancellation fee applies.
• Failure to attend without notice: no refund.

Payment Terms

Payment is required within 24 hours of booking.

Bookings are confirmed only once payment has been received and proof of payment has been emailed to Earthly Alchemy.

Consultation details will then be provided.

12. Acceptance of Agreement

By signing up for a sample, completing your purchase or an online membership registration you acknowledge that you have:

• Read this Membership Agreement in full.
• Understood and accepted all terms and conditions.
• Accepted the waiver of responsibility.
• Agreed to abide by the principles and values of Earthly Alchemy.
• Accepted that your electronic registration constitutes your legally binding acceptance of this agreement.

For the purposes of this agreement, it is here now agreed upon by all parties involved, signing up for a sample, completing the purchase or online registration are deemed as the same as a signature or autograph and that a digital acknowledgment carries the same responsibilities and liabilities as a signature or autograph.
